Mediation is an Alternative or Appropriate Dispute Resolution (ADR) process, unlike arbitration or litigation, where a third party (judge or arbiter) makes the decision for you. The parties (disputants) empower themselves to determine the outcome of their dispute. Mediation is less expensive and more expedient than arbitration or litigation. The parties are assisted by a neutral, impartial third party called the mediator. The mediator assists the parties in devising potential options to aid in resolving their differences, in effect aiding the disputants in attempting to reach resolution that is mutually agreed upon.
The process is completely voluntary, thereby supporting self determination on the part of the disputants. Various techniques are used to develop a non-adversarial environment so that if resolutions are reached they expectantly will be pro-actively supported by the disputants who produce the outcome. It is imperative that all of the principle disputants (stakeholders) commit to the utilization of mediation as a means to attempt to resolve their issues, if the process is to have an opportunity for success.
